Basic Rights of Agency Workers

Essentially, people who are hired through the mediation of organisations that specialise in matching staff and employers should be treated equally with their counterparts who are doing full-time work in the same company. Unlike the regulars, however, there may be certain privileges or features that former are not entitled to receiving.

The agency-sourced labour force share a number of rights similar to that of the permanent ones. They also can enjoy paid holidays, minimum wages, breaks, and limits on working hours. Unlawful deductions in their salaries are also not permitted.

On the first of October 2012, an updated regulation was issued by the government, wherein those employed via agencies can become eligible to enjoy the privileges that the permanent staff have after being on the job for 12 weeks. They will be able to receive extras in their shift allowances, basic pay, performance bonuses, maternity rights, and overtime, but will still not be given redundancy remuneration, claim compensation for unfair dismissals, or health insurance. Other benefits that will be opened to them are the use of the canteen, crèche, and transport services of the employer. The opportunity to apply for internal job vacancies will be made available to them as well.

Agency workers are typically given a contract for services agreement, which clarifies that they are not under regular employment conditions by the firm they will be working for. And though the said company is not really obliged to search for careers to offer to them, the prospective applicants are also not compelled to accept whatever job the occupation hunters may come across for them.
